First-Offense DUI Attorney in Ocean City
Former Prosecutors Defending First-Time DUI Charges in Worcester County
A first-offense DUI in Maryland is a criminal charge. It carries real jail exposure, license suspension, and a record that can follow you for years. Andrew and Cynthia MacDonald are former prosecutors who now defend clients across the Eastern Shore of Maryland, including Ocean City and Worcester County. Andrew prosecuted more than 100 jury trials in Wicomico County, ranging from DUI to murder. That background means we don’t have to guess how the state builds its case. We’ve built those cases ourselves.
Ocean City draws large numbers of out-of-state visitors every summer, and many first-offense DUI defendants are tourists who have never faced criminal charges before. Regardless of where you live, a first-offense DUI is not a minor traffic matter. We serve Ocean City clients directly, with an office available by appointment. Free consultations are available by phone or online.
Time matters after a DUI arrest. You have 10 days to request an MVA hearing or face automatic license suspension. Call (410) 348-7809 now to speak with a first-offense DUI attorney in Ocean City, or contact us online to schedule your free consultation.
What a First-Offense DUI Conviction Means in Maryland
Under Maryland Transportation Article 21-902, a first-offense DUI (blood alcohol concentration of 0.08% or higher) carries up to one year in jail and a fine up to $1,000. Twelve points are assessed to your driving record, triggering automatic license revocation. A first-offense DWI, where your blood alcohol concentration is 0.07%, carries up to 60 days in jail, a fine up to $500, and 8 points on your record.
The administrative and criminal consequences run on separate tracks. The Maryland Motor Vehicle Administration (MVA) may suspend your license for 180 to 270 days, independent of any court outcome. As of October 1, 2024, an ignition interlock device (IID) is mandatory as a condition of probation for a first-offense DUI conviction, with a minimum participation period of six months. You have exactly 10 days from the date of arrest to request an MVA hearing to contest the administrative suspension. Miss that deadline and the suspension begins automatically.
The consequences don’t stop there:
- Employment: Jobs requiring a clean driving record or professional license can be jeopardized by a DUI conviction
- International travel: Canada and certain other countries can deny entry to individuals with a DUI conviction on their record
- Insurance: A conviction typically triggers significant rate increases
- Underage and commercial drivers: Maryland’s zero-tolerance policy sets the threshold at 0.02% for drivers under 21; commercial drivers face a 0.04% threshold

How We Defend First-Offense DUI Cases in Ocean City
Every case starts with a thorough review of what happened before the arrest. Because we’ve prosecuted DUI cases, we assess what evidence the state actually has before any plea decision is made. That means our clients understand their real options, not just what sounds favorable.
Challenging the Traffic Stop
We examine whether the officer had a legal basis for the stop in the first place. Evidence obtained through an unlawful stop can be challenged for suppression, which can affect the trajectory of a case.
Scrutinizing Field Sobriety Tests
Field sobriety tests aren’t infallible. Results can be affected by medical conditions, footwear, road surface, lighting, and other factors that have nothing to do with impairment. We scrutinize how those tests were administered and documented.
Reviewing Breathalyzer Evidence
We review breathalyzer calibration records, maintenance logs, and the administration protocol for potential challenges to the reported blood alcohol concentration reading.
